Residential Membership Terms & Conditions

FuelXpress Mobile Fueling, LLC

These Residential Membership Terms & Conditions (“Agreement”) govern participation in the FuelXpress Mobile Fueling, LLC (“FuelXpress,” “Company,” “we,” “us,” or “our”) Residential Membership Program. By enrolling in the Residential Membership, you (“Customer”) agree to the following terms:

1. Membership Enrollment

Enrollment in the Residential Membership program constitutes agreement to these Terms & Conditions. Membership is limited to one residential service address and covers up to two (2) vehicles owned or authorized by the Customer at that address.

2. Membership Fee

The Residential Membership fee is $29.99 per month.
The membership fee:

• Is billed monthly

• Is non-refundable once charged

• Covers up to two (2) vehicles at the enrolled address

• Does not include the cost of fuel

Fuel charges are billed separately.

3. Fuel Minimum Requirement

A minimum of fourteen (14) gallons per visit is required for residential service. If the minimum volume is not met at the time of delivery, FuelXpress reserves the right to charge for the minimum delivery volume.

4. Fuel Pricing

Fuel pricing is determined at the time of delivery and is based on transparent, market-based pricing. Pricing may fluctuate due to wholesale market conditions, transportation costs, supply availability, and other factors.

Membership does not lock in fuel pricing.

5. Payment Authorization

By enrolling, Customer authorizes FuelXpress to:

• Store payment information securely

• Automatically charge the monthly membership fee

• Automatically charge all fuel delivery charges

• Charge applicable service fees as described herein

A valid payment method must be maintained on file at all times.

6. Failed or Declined Payments

If a payment is declined:

• Service may be suspended immediately

• Outstanding balances must be paid before future service

• Repeated failed payments may result in membership cancellation

FuelXpress reserves the right to charge reasonable processing or administrative fees associated with failed payments.

7. Service Scheduling

Fuel delivery is performed on a route-based schedule determined by FuelXpress. While preferred service timing may be considered, FuelXpress retains sole discretion over final scheduling.

Service dates may be adjusted due to:

• Weather conditions

• Equipment issues

• Safety concerns

• Route optimization

• Supply availability

• Operational requirements

FuelXpress does not guarantee exact delivery times.

8. Vehicle & Property Access

Customer is responsible for ensuring:

• Vehicles are safely accessible

• Fuel doors are unlocked if required

• Clear and safe access to the vehicle

• Adequate space for fueling equipment

• Safe property conditions (no hazards)

If a vehicle is inaccessible or conditions are unsafe at the time of service, FuelXpress may:

• Decline to fuel

• Charge a missed service fee

• Reschedule at its discretion

9. Safety & Right to Refuse Service

FuelXpress reserves the right to refuse or discontinue service if:

• Conditions are unsafe

• Environmental risks are present

• Equipment cannot be operated safely

• The property presents hazards

• Customer behavior is abusive or non-compliant

Safety decisions are made at FuelXpress’s sole discretion.

10. Environmental & Spill Responsibility

FuelXpress follows industry-standard spill prevention procedures. Customer agrees to promptly notify FuelXpress of any concerns related to delivery.

Customer acknowledges that minor incidental drips associated with normal fueling operations may occur and do not constitute negligence.

11. Limitation of Liability

To the fullest extent permitted by law:

FuelXpress shall not be liable for:

• Indirect or consequential damages

• Lost profits or business interruption

• Delays caused by weather or supply chain issues

• Pre-existing vehicle or fuel system issues

FuelXpress’s total liability shall not exceed the amount paid for the specific service giving rise to the claim.

12. Cancellation

Customer may cancel membership at any time prior to the next billing cycle.

Cancellation:

• Does not result in partial month refunds

• Does not waive outstanding charges

• Becomes effective at the end of the current billing period

FuelXpress reserves the right to cancel membership at its discretion.

13. Modifications to Terms

FuelXpress reserves the right to update or modify these Terms & Conditions at any time. Continued participation in the membership program constitutes acceptance of any updated terms.

14. Governing Law

This Agreement shall be governed by the laws of the State of Alabama.

15. Entire Agreement

These Terms & Conditions constitute the entire agreement between Customer and FuelXpress Mobile Fueling, LLC regarding the Residential Membership program.
