FuelXpress Mobile Fueling, LLC

Last Updated: March 2026These Marine Fueling Terms & Conditions (“Agreement”) govern dockside and waterfront fuel delivery services provided by FuelXpress Mobile Fueling, LLC (“FuelXpress,” “Company,” “we,” “us,” or “our”). By requesting marine fueling services, you (“Customer”) agree to the following:
1. Service Scope
FuelXpress provides scheduled dockside delivery of gasoline and/or diesel fuel to vessels at approved marinas, private docks, or waterfront properties within our service area.
All service is subject to operational approval and safe access conditions.
2. Pricing
Fuel is billed at transparent, market-based pricing at the time of delivery. Pricing may fluctuate due to wholesale fuel markets, transportation costs, and supply conditions.
Quotes, if provided, are estimates and not guaranteed unless confirmed in writing.
3. Minimum Delivery Requirement
A minimum fuel volume may apply per visit. FuelXpress reserves the right to establish or modify minimum delivery thresholds based on location and operational efficiency.
4. Payment Terms
A valid payment method must be maintained on file prior to service. FuelXpress is authorized to charge the full amount of fuel delivered, applicable service fees, and any approved surcharges to the payment method provided.
Commercial marine accounts may be approved for invoicing at FuelXpress’s discretion.
5. Dock & Vessel Access
Customer is responsible for ensuring:
Safe dock access
Secure mooring of vessel
Clear fueling access points
Adequate lighting and safe working conditions
Compliance with marina rules
If access is unsafe or restricted, FuelXpress may decline service without liability.
6. Environmental & Spill Procedures
FuelXpress follows industry-standard spill prevention practices. In the event of a fuel spill:
Customer agrees to cooperate with reporting and mitigation procedures.
Customer acknowledges that minor incidental drips associated with normal fueling operations do not constitute negligence.
Customer is responsible for maintaining vessel fuel systems in safe working condition.
7. Weather & Operational Delays
Marine fueling may be delayed or rescheduled due to:
Weather conditions
Water conditions
Safety concerns
Marina access restrictions
Equipment or supply constraints
FuelXpress does not guarantee specific delivery times.
8. Limitation of Liability
To the fullest extent permitted by law, FuelXpress shall not be liable for:
Indirect or consequential damages
Vessel mechanical issues
Pre-existing fuel system defects
Business interruption
Weather-related delays
FuelXpress’s total liability shall not exceed the amount charged for the specific fueling service giving rise to the claim.
9. Right to Refuse Service
FuelXpress reserves the right to refuse or discontinue service if:
Conditions are unsafe
Environmental risks are present
Equipment cannot be operated safely
Customer fails to comply with dock or marina rules
Safety determinations are made at FuelXpress’s sole discretion.
10. Governing Law
This Agreement shall be governed by the laws of the State of Alabama.
11. Entire Agreement
These Terms & Conditions constitute the entire agreement between Customer and FuelXpress Mobile Fueling, LLC regarding marine fueling services.
